Permanent Secondment in a Group of Companies and Transfer of Undertaking

Is an employee who is employed by a staff entity and seconded to an operating company transferred by operation of law if (part of) the activities of the operating company are assigned to a third party? The Court of Appeal of Amsterdam intends to refer this question for a preliminary ruling to the European Court of Justice. This article deals with the discussion on permanent secondment in a group of companies and transfer of undertaking, as well as with the law of the Netherlands, France, England, Germany and Belgium.
