The Termination of a Bank Guarantee in order to Lift an Attachment; the Importance of Careful Formulation

Marcel Willems

Marcel Willems studied law at the Universities of Nijmegen, Leiden, Berlin and Osnabrück (Germany). He has been an attorney since 1988 and one of the co-founders of Kennedy Van der Laan. Since 1992 he has focused his practice on corporate and commercial litigation, insolvency law, financial security, financial restructurings and (re)financing schemes and directors and officers liability. He acts for several banks, particularly in the areas of security rights and insolvency. Also, he regularly advises on complex financings.

He is author and co-author of a number of publications on insolvency law and he frequently publishes articles on corporate law, litigation and insolvency.

Marcel draws remarkable parallels between his legal work and his hobby of gardening. In both he prunes away all that is unnecessary, he digs deeply in the ground (facts and legal precedents) and creatively designs, plants and organizes both his garden en his legal documents to reach balanced and optimal results.
